1. About these terms
These Terms & Conditions ("Terms") apply to your use of the Fourth Trimester Friend website, online storefront and social channels, and to your purchase of our digital products and services. Fourth Trimester Friend ("FTF", "we", "us") is operated by Tatiana McGee, a sole trader registered in New South Wales, Australia (ABN: 21652664029). By using our website or purchasing from us, you agree to these Terms.
2. Our products and services
We offer digital products, including an online course and downloadable guides and workbooks ("Digital Products"), and from time to time one-on-one consultations and related services ("Services"). Product descriptions, inclusions and prices are set out on the relevant sales page at the time of purchase.
3. Educational content — not medical advice
All FTF content, including our courses, downloads, emails and social media content, is general educational information only. It is not medical, nursing, midwifery, lactation or mental health advice, and it does not create a healthcare provider–patient relationship. Always consult your own doctor, paediatrician, midwife or child health nurse about your baby’s health and your own. See our Medical Disclaimer for full details, which forms part of these Terms.
4. Purchases and payment
Payments are processed through our third-party checkout provider. Prices are displayed at checkout in the currency indicated and may change at any time, but changes will not affect purchases already completed. You are responsible for providing accurate billing information. Access to Digital Products is granted once payment has been successfully processed.
5. Licence and permitted use of Digital Products
When you purchase a Digital Product, we grant you a personal, non-exclusive, non-transferable licence to access and use it for your own personal, non-commercial use. You must not:
Share, forward, resell, sublicense or distribute course materials, downloads, workbooks or login access to any other person
Copy, reproduce or republish any content except for your own personal use
Use our content to create competing products or services
We may suspend or revoke access, without refund, where we reasonably believe an account is being shared or content is being redistributed.
6. Course access
Course access is provided for the period stated on the sales page (or, if none is stated, for the life of the course while it remains actively offered). We may update, improve or replace course content from time to time. If we retire a course, we will give reasonable notice and, where practicable, an opportunity to download included materials.
7. Refunds
Because Digital Products are delivered instantly and cannot be returned, we do not offer refunds for change of mind, or because you did not use the product, once access has been granted. Any launch-specific guarantee (for example a satisfaction guarantee) will be stated on the sales page and honoured on its terms.
Nothing in these Terms excludes your rights under the Australian Consumer Law or any equivalent consumer protection law in your country. If a Digital Product or Service fails to meet a consumer guarantee (for example, it is faulty, not fit for purpose or not as described), you are entitled to the remedies provided by law, which may include a repair, replacement or refund.
8. One-on-one services
Where you book a consultation or other Service, the booking is confirmed on payment (or as otherwise stated at booking). Rescheduling and cancellation terms will be stated at the time of booking. Consultations provide general guidance and education and are not a substitute for medical care.
9. Intellectual property
All content on our website, courses, downloads and social channels — including text, videos, workbooks, graphics, logos and branding — is owned by or licensed to FTF and is protected by copyright and other intellectual property laws. Except for the personal-use licence in clause 5, no rights are granted to you.
10. Your conduct
You agree not to misuse our website or products, including by attempting to gain unauthorised access, interfering with their operation, or using them for any unlawful purpose. Where community features exist (such as comments or group spaces), you agree to engage respectfully; we may remove content or restrict access at our discretion.
11. Third-party tools and links
Our website and products may link to or rely on third-party platforms and tools (for example payment processors, course hosting and email providers). We are not responsible for the content, availability or privacy practices of third-party sites and services.
12. Limitation of liability
To the maximum extent permitted by law, FTF excludes all liability for indirect or consequential loss arising out of or in connection with our website, Digital Products or Services. Where liability cannot be excluded but can be limited, our liability is limited, at our option, to resupplying the relevant product or service or refunding the amount you paid for it. Nothing in this clause excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, including under the Australian Consumer Law.
13. Testimonials and results
Testimonials reflect individual experiences. Every family and baby is different, and we make no guarantee that you will achieve any particular outcome from using our products.
14. Changes to these Terms
We may update these Terms from time to time. The version published on our website at the time of your purchase applies to that purchase. Continued use of the website after changes are published constitutes acceptance of the updated Terms.
15. Governing law
These Terms are governed by the laws of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of the courts of New South Wales. If you are a consumer outside Australia, you may also have rights under the laws of your own country that these Terms do not affect.
